TERMS & CONDITIONS

These Terms and Conditions ("Terms") form a binding legal agreement between you ("you", "User", "Participant") and SOLKANA GLOBAL, the software development company that owns, develops, publishes, and operates SOLKOMBAT (the "Game"), the solkombat website, and all related applications, builds, downloads, APIs, campaigns, and services (collectively, the "Services"). By accessing, browsing, downloading, installing, registering for, or otherwise using any part of the Services, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, you must immediately stop using the Services.

• You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or participate in any campaign, reward, or points programme. • Users aged 13–17 may access public informational pages only with verifiable consent from a parent or legal guardian, who accepts these Terms on their behalf and is responsible for their activity. • You may not use the Services if you are located in, ordinarily resident in, or organised under the laws of any jurisdiction subject to comprehensive sanctions, or if you appear on any restricted-party or sanctions list. • You may not use the Services if you have previously been suspended or banned by SOLKANA GLOBAL.

Subject to your continuous compliance with these Terms, SOLKANA GLOBAL grants you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Services and to install and run any officially distributed build of the Game solely for personal, non-commercial entertainment. The Services are licensed, not sold. No title or ownership interest is transferred to you. All rights not expressly granted are reserved by SOLKANA GLOBAL.

You agree that you will not, and will not permit others to: • reverse engineer, decompile, disassemble, decrypt, extract assets from, or attempt to derive the source code, models, shaders, or algorithms of the Game or any component of the Services, except to the minimum extent such restriction is prohibited by applicable law; • copy, modify, translate, adapt, port, create derivative works of, rent, lease, lend, sell, sublicense, distribute, host, or publicly perform the Services; • use cheats, aimbots, macros, automation, emulators, memory editors, packet manipulation, exploits, unpublished bugs, or any unauthorised third-party software that confers an advantage or alters gameplay; • operate bots, scrapers, crawlers, or automated harvesting against the Services, or circumvent rate limits, authentication, RLS, or any technical protection measure; • probe, scan, stress-test, denial-of-service, or otherwise interfere with the integrity, security, or performance of the Services or their infrastructure; • impersonate any person, misrepresent affiliation with SOLKANA GLOBAL, or use another person's account, wallet, or social media identity; • upload or transmit unlawful, infringing, defamatory, hateful, harassing, sexually explicit, violent-extremist, malicious, or malware-bearing content; • use the Services for money laundering, fraud, unlicensed gambling, market manipulation, or any unlawful purpose; • remove, obscure, or alter any proprietary notice, watermark, logo, or attribution.

• You are solely responsible for all activity under your account and for maintaining the confidentiality of your credentials. • You must provide accurate, current, and complete registration information, including any social media handles you submit. • One account per person. Multi-accounting, account sharing, selling, buying, or transferring accounts is strictly prohibited. • You must notify us promptly of any suspected unauthorised access. SOLKANA GLOBAL is not liable for losses arising from your failure to secure your account.

Participation in the SOLKOMBAT influencer campaign is voluntary and governed by these Terms together with any campaign-specific rules published on the Services. • The social media username on every submitted post must be identical to the verified handle saved on your dashboard. Submissions from third-party or mismatched accounts are rejected and may result in disqualification. • Points are awarded by automated and manual review at SOLKANA GLOBAL's sole discretion based on published scoring rules. Scoring formulas, caps, and daily limits may be changed, recalculated, or reset at any time. • Points have no monetary value, are not property, are not securities, are not a currency or financial instrument, are not redeemable for cash by default, and are non-transferable except as expressly permitted in writing. • Engagement farming, purchased engagement, bot comments, engagement pods, deleted or edited posts, private accounts, misleading claims, undisclosed paid promotion, or any attempt to inflate metrics will void affected submissions and may forfeit all accrued points. • You must comply with the terms of the relevant platform (including X and TikTok) and with all applicable advertising-disclosure laws and regulations. You are an independent participant, not an employee, agent, partner, or joint venturer of SOLKANA GLOBAL. • SOLKANA GLOBAL may withhold, adjust, or revoke points or rewards, and may suspend or terminate participation, without liability, where fraud, abuse, or breach is suspected. Any determination by SOLKANA GLOBAL is final. • You are solely responsible for any taxes, levies, or reporting obligations arising from rewards you receive.

You retain ownership of content you create and submit ("User Content"). By submitting User Content, links, posts, clips, artwork, feedback, or promotional material relating to SOLKOMBAT, you grant SOLKANA GLOBAL a worldwide, perpetual, irrevocable, royalty-free, fully paid, sublicensable, transferable licence to host, store, reproduce, adapt, publish, translate, create derivative works from, distribute, display, and otherwise exploit that content in any media for any purpose, including marketing and promotion of the Game, together with the right to use your handle, display name, and public profile image for attribution. You represent and warrant that you own or control all rights in your User Content, that it does not infringe any third-party right, and that it complies with all applicable law. Any suggestions, ideas, or feedback you provide are non-confidential and may be used by SOLKANA GLOBAL without compensation or attribution.

SOLKOMBAT, the SOLKOMBAT logo, SOLKANA GLOBAL, all characters, fighters, names, arenas, environments, 3D models, textures, rigs, animations, artwork, UI, music, sound effects, narratives, source code, engines, tools, databases, trade dress, and all other content of the Services are the exclusive property of SOLKANA GLOBAL or its licensors and are protected by copyright, trademark, trade secret, design, and other intellectual-property laws worldwide. No trademark or brand licence is granted by these Terms. Limited promotional use of official brand assets, unmodified and in accordance with any published brand guidelines, is permitted only for the purpose of promoting SOLKOMBAT and may be revoked at any time.

If you believe content on the Services infringes your copyright, send a notice identifying the work, the material claimed to infringe and its location, your contact details, a statement of good-faith belief, a statement that the information is accurate, and your electronic signature, to our contact channels listed in section 21. We may remove allegedly infringing content and terminate repeat infringers.

• Any in-game currency, cosmetic, skin, or virtual item is a limited licence to use a digital feature; it is not your property, has no cash-out value unless expressly stated, and may be modified or removed. • Nothing on the Services is an offer or solicitation to buy or sell any security, token, or financial product, nor is it investment, legal, tax, or financial advice. • If any blockchain or digital-asset feature is offered, you acknowledge irreversible transactions, network fees, volatility, smart-contract risk, key-loss risk, and total loss of value. You interact at your own risk and are solely responsible for wallet security and regulatory compliance in your jurisdiction. • SOLKANA GLOBAL does not endorse and is not responsible for third-party tokens, markets, or projects that reference SOLKOMBAT without written authorisation.

• Prices are shown at the point of purchase and may change. You authorise us and our payment processors to charge your selected payment method for all amounts due, including applicable taxes. • Except where a non-waivable statutory right applies, all purchases of digital content are final and non-refundable once delivery or access begins. • Chargeback abuse, fraudulent payment, or reversal may result in immediate suspension and forfeiture of associated items and points. • Subscriptions, if offered, renew automatically until cancelled; you may cancel at any time effective at the end of the current billing period.

The Game and Services may be provided in pre-release, alpha, beta, playtest, or early-access form and may contain defects, incomplete features, balance issues, or data loss. SOLKANA GLOBAL may add, modify, suspend, degrade, wipe progress, discontinue, or shut down any feature, server, build, campaign, or the Services as a whole, at any time, with or without notice, and without liability to you.

The Services may integrate or link to third-party platforms including X, TikTok, Telegram, authentication providers, hosting, analytics, and payment processors. Your use of those services is governed by their own terms and privacy policies. SOLKANA GLOBAL does not control and is not responsible for third-party content, availability, data practices, or acts and omissions.

A very small percentage of individuals may experience seizures, blackouts, eye strain, motion sickness, or repetitive-strain injury when exposed to flashing lights, patterns, or extended play. Take regular breaks, play in a well-lit room at a reasonable distance, and stop immediately and consult a physician if you experience adverse symptoms. Do not play while operating a vehicle or machinery. You assume all risk associated with your use of the Game.

The Services are provided "as is" and "as available", with all faults and without warranty of any kind. To the maximum extent permitted by law, SOLKANA GLOBAL and its officers, directors, employees, contractors, licensors, and suppliers disclaim all warranties, express, implied, statutory, or otherwise, including merchantability, fitness for a particular purpose, title, quiet enjoyment, accuracy, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, free of harmful components, or that any defect will be corrected, or that points, rewards, data, or progress will be preserved.

To the maximum extent permitted by law, SOLKANA GLOBAL shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, points, rewards, digital assets, business opportunity, or anticipated savings, arising out of or relating to the Services, whether based in contract, tort, negligence, strict liability, or otherwise, even if advised of the possibility of such damages. The total aggregate liability of SOLKANA GLOBAL for all claims relating to the Services shall not exceed the greater of (a) the total amount you paid to SOLKANA GLOBAL in the twelve months preceding the event giving rise to the claim, or (b) USD 100. Some jurisdictions do not allow certain exclusions or limitations; in those jurisdictions our liability is limited to the smallest extent permitted by law. Nothing in these Terms excludes liability for fraud, wilful misconduct, or any liability that cannot lawfully be excluded.

You agree to defend, indemnify, and hold harmless SOLKANA GLOBAL and its affiliates, officers, directors, employees, agents, contractors, and licensors from and against any claims, demands, actions, liabilities, damages, losses, penalties, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the Services; (b) your User Content or promotional posts; (c) your breach of these Terms or of any law, regulation, or third-party right, including platform rules and advertising-disclosure obligations; (d) your cheating, fraud, or engagement manipulation; or (e) any tax obligation arising from rewards you receive.

SOLKANA GLOBAL may suspend, restrict, ban, or terminate your access, account, submissions, points, and licence at any time, with or without notice, for suspected breach of these Terms, suspected fraud or abuse, legal or regulatory requirement, or for any other reason at our sole discretion. On termination, your licence ends immediately and you must cease all use of the Services and delete all copies of the Game. Sections concerning intellectual property, user-content licences, disclaimers, limitation of liability, indemnification, and dispute resolution survive termination.

These Terms and any dispute arising from them or the Services are governed by the laws of the jurisdiction of incorporation of SOLKANA GLOBAL, without regard to conflict-of-law rules. Before commencing any formal proceeding, you agree to attempt good-faith informal resolution by contacting us and allowing 30 days to resolve the matter. Any unresolved dispute shall be settled by final and binding arbitration on an individual basis, conducted in English by a single arbitrator, save that either party may seek injunctive relief in court to protect intellectual property. You and SOLKANA GLOBAL waive any right to a jury trial and to participate in a class, collective, consolidated, or representative action. Any claim must be brought within one year of the event giving rise to it, or it is permanently barred.

• Entire agreement: these Terms, plus the Privacy Policy and any campaign rules, constitute the entire agreement between you and SOLKANA GLOBAL. • Severability: if any provision is held unenforceable, it shall be modified to the minimum extent necessary and the remainder stays in force. • No waiver: failure to enforce a provision is not a waiver of it. • Assignment: you may not assign these Terms; SOLKANA GLOBAL may assign them freely, including in a merger, acquisition, or sale of assets. • Force majeure: we are not liable for delay or failure caused by events beyond our reasonable control, including outages, network or blockchain failures, cyber-attacks, acts of God, war, or government action. • Changes: we may update these Terms at any time by posting a revised version with a new effective date. Continued use after changes constitutes acceptance. • Language: the English version of these Terms prevails over any translation.
